
I finally got my hands on the Public Interest Litigation filed by the society of Indian Law Firms on the Union of India and State of Maharashtra. Have attached a copy for you to read. This is surely very insightful and a proof that the Indian citizens are not going to take the government inaction lightly.
The Public Interest Litigation is seeking immediate implementation of police modernization measures. Noteworthy among them include Cyril Shroff, Managing Partner, Amarchand Mangaldas; Amit Chandra, MD, Bain Capital; Cyrus Guzder, CMD, AFL; and Lalit Bhasin, President, SILF.
Public Interest Litigation, in Indian law, means litigation for the protection of public interest. It is litigation introduced in a court of law, not by the aggrieved party but by the court itself or by any other private party. It is not necessary, for the exercise of the court’s jurisdiction, that the person who is the victim of the violation of his or her right should personally approach the court. Public Interest Litigation is the power given to the public by courts through judicial activism.
Public Interest Litigation has a lot of similarites to the Class Action Law Suits filed in the US. I must admit I am not a student of law and someone with good law knowledge can give you more details.

It is a welcome step in a democratic political set up where we are supposed to have the independence of judiciary. All public-spirited persons would love this belated development. More and more such development will have a check on our politicians in power who are engaged in converting the democracy into family fief, often throttling the cherished goals and ideals of the democracy. It is a sacred duty of all citizens to lend support to those who have endeavoured and ventured to file this public interest litigation (PIL), a concept which was introduced in this country by Justice P.N. * the appointment of an enquiry panel to probe the terror attacks,
* seeks action against those advising the government on national security,
* alleges that top bureaucrats and politicians were ”negligent” and ”irresponsible” in doing their jobs and in letting the attacks take place,
* as in the case of the 1993 Mumbai riots, an inquiry by the senior sitting judge of the High Court should be launched to look into the lapses of government machinery that was unable to prevent the attacks that started on November 26.
The SILF’s petition deemed to be more constructive and the highlights are as follows:
* seeks the setting up of a Quick Response Team, proposed by the state government in 2002 to tackle terrorist-related threats,
* stationing of a permanent unit of the National Security Guards (NSG) that led the rescue operations in the recent attacks,
* implementation of the recommendations made by the National Police Commission Reports,
* better protection of the state’s coastline,
* setting up of a crisis management plan,
* setting up of citizens’ coordination committees,
* installation of CCTV cameras at key sites,
* implementation of the recommendations made by the McKinsey Report (2006),
* a time-bound plan to train and better equip the police and security personnel,
* states that contrasting this to how New York City (NYC) tightened its laws and upgraded security measures post 9/11,
* says the measures taken by NYC have ensured that there has been no recurrence of terror attacks
Bravo. Now it is a full story and speaks of the genuine concern of the citizens of this country who feel duped, cheated by politicians, irrespective of their hues and colours.
